This Isn't Perry Mason

While watching any famous trial on HLN, have you ever yelled at your tv with impatience, as you wondered why the trial is not like "Perry Mason?"

For many years, we have been entertained by the surprise attacks, trial by ambush and consistent wins in one hour - until social media and the tv cameras were allowed to be in the courtrooms.

Long before the trial occurs what happens to even allow the trial to take place?

"California Civil Litigation," a textbook designed to walk readers from the point in which a prospective client contacts an attorney's office through gathering material facts (facts that make a difference in the case); writing what is necessary in the right format; setting calendar dates to be heard by the judge; and, not only presenting the case but also being prepared for if there needs to be an appeal.

Many people say that they were wronged and that justice should be served, but can you put your complaint in the context of the law?

Other than applying your complaint/allegation to what the law says, it's important for attorneys and paralegals to be able to:

1. Write and fairly attack pleadings (documents that define the allegation
and remedy);
2. Create and conduct discovery (process that focuses upon the legal issues
and eliminates the trial by ambush);
3. Calendar: Every step towards your goal to win the case must be
calendared according to the rules within your state (if you are doing
state-level litigation);
4. Trial-setting: If you and the opposing party have not settled this
case,
the judge will review the issues, before setting a trial;
5. Trial: This is where all preparation and consideration come together;
6. Post-Trial: The military might call this your "after action
assessment;" and
7. Appeals: Determines whether or not the law was properly applied.

This is a great book whether you are a student, a litigant with an attorney or someone representing yourself, because there are no assumptions in this book.

And, while there are many excellent examples of pleadings and other documents, at the close of each chapter, it's important to check with the court of your state and county, to use the appropriate rules.

I especially like that although this book is written based upon California Civil litigation, the authors managed to compare the Federal Rules in each chapter, without taking away from each chapter's message.

Disappointing

The organization of this text is a nightmare. Scattered throughout are examples of Judicial Council forms and attorney-prepared documents that absolutely belong in an appendix. Finding what you want to read about in a chapter supposedly dedicated to that issue requires flipping through all of this extraneous crap.

The prose is confusing, and often creates more questions than it answers; it's also very limited. Take out all of the examples of prepared forms and docs and the amount of instructional text wouldn't have qualified as a book about civil litigation.

VERY disappointed that my program has chosen this text, despite instructors' input. They don't appreciate it either.

A Must Read For Company Management in CA

If you are anywhere in the management chain of command of a company (all the way to CEO) and doing business in California (the most litigious state in the most litigious country) this book will give you an excellent idea of what your attorneys should and should not be doing. Because it is written for paralegals it is easy to understand and explains/defines much of the legal jargon. Unfortunately you cannot rely on county and state agencies to protect your company so you had better arm yourself with some knowledge!
